Terms of Use — MathGeni

These Terms of Use (“Terms”) govern your access to and use of the MathGeni iOS application and any related services (collectively, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy for MathGeni (incorporated by reference). If you do not agree, do not use the Service.
1) Who May Use MathGeni
- You must be at least 13 years old. Where local law requires a higher age (e.g., 16+ in some regions like the EU), you must meet that requirement.
- No account is required to use MathGeni. If you send us feedback, you may provide your email address voluntarily.
2) App License & Ownership
- We grant you a limited, personal, revocable, non-transferable, non-sublicensable license to use the iOS app solely for lawful, personal, non-commercial purposes.
- The Service (including code, design, text, graphics, trademarks, and logos) is owned by AppBound and protected by IP laws. We reserve all rights not expressly granted.
3) User Content & Permissions
- Your content. You may input or upload text or images of math problems (“User Content”). You retain ownership of your User Content.
- License to operate the Service. You grant AppBound a worldwide, non-exclusive, royalty-free license to host, process, display, and otherwise use User Content as necessary to provide and improve the Service.
- Quality & model improvement. You grant permission for AppBound to use anonymized and/or aggregated User Content and usage data to improve quality, including AI prompts, safety, and features. We will not attempt to re-identify you.
- You are responsible for backing up your User Content.
4) AI Outputs & Educational-Only Disclaimer
- MathGeni uses AI services (OpenAI) to generate suggestions, explanations, and solutions. AI can be wrong or incomplete.
- The Service is for educational use only and is not professional tutoring or guaranteed accurate guidance. Always verify results independently.
- You agree not to rely on the Service for high-stakes or proctored situations (e.g., exams where external help is prohibited).
5) Prohibited Uses
You agree not to:
- Violate laws, third-party rights, or school/assessment rules (including cheating on exams or assignments that prohibit external assistance).
- Upload or share illegal, infringing, harassing, harmful, or deceptive content.
- Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying models.
- Circumvent security or rate limits; use bots to send excessive or abusive traffic.
- Scrape, index, or create datasets from the Service or its outputs.
- Resell, lease, or provide the Service to third parties as a service bureau.
- Attempt to re-identify individuals from anonymized/aggregated data or use outputs to build competing foundation models.
- Use the Service in ways that violate OpenAI or other third-party provider terms.
6) Third-Party Services
We use third-party providers such as OpenAI (AI inference), Firebase (infrastructure), and Google Analytics (analytics). Your use is also subject to their applicable terms/policies. See our Privacy Policy for MathGeni for data practices.
7) Location & Device Permissions
- Certain core features and service operations may request precise location and device permissions. If you disable or do not grant these, some or all features may not function.
- Data handling is detailed in the Privacy Policy for MathGeni.
8) Payments, Subscriptions & Refunds (Apple In-App Purchase)
- MathGeni is free to install and may offer In-App Purchases (IAP) and/or auto-renewing subscriptions managed through Apple.
- Billing & Renewal: If subscriptions are offered, they auto-renew unless canceled via your Apple ID settings at least 24 hours before the current period ends.
- Trials: If a free trial is offered, unused portions may be forfeited upon purchase.
- Refunds: All billing and refunds are handled by Apple per Apple’s policies.
- Manage subscriptions in your Apple ID settings.
9) Service Changes & Availability
We may add, modify, or remove features; suspend or terminate the Service; or restrict access to some or all users at any time. We are not liable for downtime, data loss, or feature changes.
10) Feedback
If you submit feedback, ideas, or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without restriction or obligation.
11) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPBOUND AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
13) Indemnification
You agree to defend, indemnify, and hold harmless AppBound and its affiliates, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your User Content; or (c) your breach of these Terms or violations of law.
14) Termination
You may stop using the Service at any time. We may suspend or terminate access immediately for any actual or suspected violation of these Terms or to comply with law. Upon termination, your license ends and you must cease use.
15) Dispute Resolution; Binding Arbitration; Class-Action Waiver
- Governing Law & Venue. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
- Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules. The arbitration will be conducted in Delaware, in English, by a single arbitrator. The Federal Arbitration Act governs the interpretation and enforcement of this section.
- Class-Action Waiver. You and AppBound agree that each may bring claims only in your/its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.
- Opt-Out. You may opt out of arbitration within 30 days after you first accept these Terms by emailing at support@appbound.app. Your opt-out will not affect other Terms.
16) International Use & Export
You must comply with all applicable export control and sanctions laws. You may not use the Service if you are located in an embargoed country or are on any restricted list.
17) Privacy
Your use of the Service is subject to the Privacy Policy for MathGeni. It explains what we collect (including precise location where required), how we use it (including anonymization for quality improvement), and your choices.
18) Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms in-app and update the Effective Date. Continued use of the Service after changes become effective constitutes acceptance.

20) Apple Terms
Your use of the Service is also subject to Apple’s applicable terms and policies (including the App Store Terms, IAP rules, and refund policies). In case of conflict about billing/refunds, Apple’s terms control.
21) Schools/Education Use
If you are a school, district, teacher, tutor, parent, or guardian using MathGeni with students:
- Age & Consent. You are responsible for ensuring students meet the applicable minimum age (13+, or higher where required) and that you obtain all necessary consents (e.g., parental consent where required by law).
- No Student Accounts Required. MathGeni does not require individual student accounts for general use; however, any optional feedback or email features should not include personal data about students unless you have consent and a lawful basis.
- Data Minimization. Do not include personally identifiable information (PII) in prompts or uploads unless strictly necessary and permitted by law and policy.
- Assessment Integrity. Do not use MathGeni in ways that violate school/assessment rules (e.g., for proctored exams or assignments that forbid external help).
- Student Privacy Laws. You are responsible for compliance with applicable student privacy laws (e.g., FERPA or analogous local laws), including providing any required notices.
- Controls & Filtering. You are responsible for classroom management, supervising use, and applying device/OS-level controls as needed.
- Location Permissions. If your deployment configurations restrict permissions, note that certain features may not work without precise location (see Section 7).
- No Special Relationship. AppBound does not act as your school’s agent or “school official” unless an executed written agreement explicitly says so.
22) DMCA/Trademark Notice & Takedown
We respect intellectual property rights and expect users to do the same.
A. DMCA Notices (Copyright)
If you believe that content available through the Service infringes your copyright, you may file a notice under the U.S. Digital Millennium Copyright Act (DMCA) by sending a written notification that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material (e.g., a specific prompt, image, or output and where it appears in the Service).
- Your contact information (name, address, telephone, and email).
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Upon receipt of a compliant notice, we may remove or disable access to the allegedly infringing material and, where appropriate, terminate repeat infringers.
B. Counter-Notification
If you believe material was removed or disabled by mistake or misidentification, you may send us a counter-notification that includes:
- Your physical or electronic signature.
- Identification of the material removed or to which access was disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the District of Delaware, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
C. Trademarks
If you believe your trademark is being used in a way that constitutes infringement or passing off, please send a notice to contact@appbound.app including:
- The mark at issue and registration details (if registered).
- Description of the unauthorized use and where it appears.
- Evidence of your rights and a statement of good-faith belief that the use is unauthorized.
- Your full contact information.
We may request additional information to assess your claim and may remove or restrict content at our discretion. Submitting a false or bad-faith notice may result in liability.
